I think you are wrong here. Beating up on Republicans for political gain is ONE thing. Making a mockery of our legal process by making a war against rogue combatants a lawsuit is another, entirely.
No Democrat wants to see long drawn out Court cases involving these scum. It would not do for thier election chances in 08 and it would take away that wedge issue for 08.
Rhetoric is one thing, reality quite another.
Expect some huff and bluff, but I wouldn't pin your hopes on the fact that the Dems see political or real world gain in actually holding such cases in civilian court.
Besides, the military tribunal law is already on the books. It would require a CHANGE IN LAW to make this so. And, that wouldn't pass a Senate filibuster OR a Presidential Veto.
Mr. President - did you ask fmr President Clinton where he hid that veto pen yet? You might actually need it now.
